General conditions of Sale
These General Conditions of Sale govern the distance selling between Monoica sas di Barel Marco & C. (REA TV-262906 and VAT no. 03328270263), with registered office in Via del Giudice, 1 - Conegliano, Treviso, Italy (hereinafter Monoica) and any Customer and have as their object the discipline of the purchase of the Istadarium product made via the internet, from the website www.istadarium.com (hereinafter Site).
These General Conditions of Sale may be subject to changes also as a result of subsequent provisions of law and / or regulations, and will be updated in the relevant section of the Site. These changes will not have retroactive effect and will be applicable only to purchase requests sent by the Customer after the date of publication of the changes.
Before carrying out each purchase, Monoica invites each Customer to read these General Conditions carefully, and, once the purchase procedure provided for on the Site has been completed, to print them and keep a copy, also in electronic format, and at the time of purchase, may copy a copy of the aforementioned general conditions of sale, in force at the time of purchase, as required by Legislative Decree 2014/21 and 2015/130 (transposes EU directive 2011/83 and 2013/11): special consumer protection rules regarding commercial information, contractual withdrawal and online dispute resolution.
Purchase method
The purchase of products on the Site is done by selecting the desired product and indicating the desired quantity and then adding it to the cart using the appropriate button. So for all products.
Once the items he intends to purchase have been selected, the Customer can access the shopping cart which offers a summary page of the selected products, their price, the permitted payment methods and any delivery options (with the relative costs).
From here we move on to the next screen which provides for the insertion of Customer data useful for shipping, billing and any notes.
If the Customer has previously registered on the Site (for example through a previous purchase) he is given the opportunity to log in, avoiding to fill in the requested data again, which however can always be changed by the Customer.
The next screen presents a complete report of all products, separate costs, total costs, quantities, payment methods chosen, shipping costs and shipping and billing data.
Here the Customer consent to the processing of personal data and to these General Conditions of Sale.
By sending the order, which has the value of a contractual purchase proposal, the Customer acknowledges and declares to have read all the information provided during the purchase procedure and to fully accept these General Conditions of Sale.
Once the payment procedure has been completed, the Customer will be redirected to the page of the site where he will find a message acknowledging the purchase request.
At the same time, the Site will send an e-mail to the address indicated with the order made.
The Customer guarantees the accuracy and truthfulness of all the data and information provided; therefore no responsibility can be charged to the Site if the incompleteness and / or inaccuracy of the data make it impossible to proceed with the supply of the requested products.
Product information
The product offered is described on the home page of the Site and within the respective sections.
It should be noted that, while trying to make the images more faithful and corresponding to the final product, there may be chromatic differences compared to the customer's expectation, sometimes also due to the different display of the product from device to device (computer monitor, laptop, tablet, smartphone etc).
Prices
The sale price shown in the product descriptions are inclusive of VAT.
The shipping cost will be added to the sale price, which may vary according to the weight and size of the final package.
Shipping prices can be summarized as follows:
- shipping in Italy: € 6.00
- shipping within Europe: € 13.00
Shipments
All deliveries of products will be at Monoica's risk. The risk will be transferred to the Customer upon delivery of the products to the Customer, or to a designated third party, by the shipper or the carrier appointed by Monoica. The courier designated by Monoica is BRT S.p.A..
Shipping costs will be calculated automatically by the Site and will be viewable and knowable by the Customer before sending the order. They vary from country to country.
For each Purchase Agreement completed through the Site, Monoica will issue a delivery note (DDT) or, for non-consumer customers who have entered their VAT number, an invoice relating to the products that will be or shipped. This documentation will be sent to customers at the indicated email address.
Deliveries will be made in the following ways:
- 1st attempt
- 2nd attempt
Cases of force majeure, unavailability of means of transport, as well as unforeseeable or inevitable events that cause a delay in deliveries or make deliveries difficult or impossible or that cause a significant increase in the delivery cost charged to Monoica will entitle the latter to split, postpone or cancel, in whole or in part, the expected delivery or terminate the Purchase Agreement. In such cases, Monoica will provide timely and adequate communication of its determinations to the e-mail address provided by the Customer and the latter will be entitled to a refund of the price already paid, excluding any further claim, in any capacity, against Monoica.
In the event of impediments to delivery due to force majeure, Monoica will contact the Customer by e-mail, telephone or other useful tool, to inform him of the delay in delivery times. Monoica cannot be held responsible in any way for any delays due to third party events and / or force majeure.
Delivery is deemed completed when the product is made available to the user at the address specified in the order form.
In the event that the package shows evident signs of tampering or alteration, the user must mark it at the time of delivery by signing the appropriate Proof of Delivery (POD) document prepared by the courier.
In addition to the shipping times, 1-2 days must be calculated for order fulfillment by Monoica.
In December the waiting times are at least 5 working days.
The courier no longer guarantees delivery within 24/48 hours.
It is recommended to indicate an address where there is always someone to receive the package.
Terms of payment
The payment of the products purchased on the Site are made using two methods:
- Stripe, an online payment platform that supports the VISA, MASTERCARD, MAESTRO and AMERICAN EXPRESS circuits, whose payments will be processed through a secure server-to-server connection using the SSL (Secure Sockets Layer) Protocol with 128-bit encryption.
- Wire transfer
Customer obligations
The customer declares and guarantees:
- to be a consumer according to the provisions of art. 3 of the Consumer Code;
- to be of age;
- that the data provided by the same for the execution of the Contract are correct and true.
By sending the order electronically, the Customer declares to have read the conditions of sale, the payment methods and the entire purchase procedure.
Return and Refund
The Customer has the right to withdraw from the Purchase Agreement for any reason and without the need to provide explanations within 14 days from the date of receipt of the products. The written request, including all the data necessary to identify the Customer and the Order, must be sent by registered letter with acknowledgment of receipt to the address: Monoica Sas, via del Giudice 1, 31015 Conegliano, Treviso. Alternatively, a PEC can be sent to the address: monoica@pcert.it. For any clarification we are always available, simply use the contact form.
The return must be made by the Customer, by shipping the products subject to withdrawal, by courier of his choice. The products must be shipped, with all the packaging precautions necessary for the correct storage of the products, within and no later than 14 days from the date on which the Customer communicated his decision to withdraw from the contract at the indicated address. The direct costs of returning the goods will be borne by the customer.
Monoica will reimburse the user the amounts paid excluding the shipping costs incurred for sending the products, in the shortest possible time and in any case within 30 days from the date of receipt of the registered letter by reimbursement with the same means with which you received the payment or by bank transfer to current account to be indicated in the withdrawal letter.
The customer will not have the right of withdrawal if it is made to measure or personalized products.

Competent and controversial court
These General Conditions are governed by the Civil Code, by the Consumer Code (Legislative Decree no. 206/2005 and subsequent amendments) and by the rules on electronic commerce (Legislative Decree no. 70/2003 and subsequent amendments). In the event of changes to the same, the General Conditions published on the Site at the time of sending the Order by the Customer will apply.
The Purchase Agreement between the Customer and Monoica is concluded in Italy and is governed by Italian law.
For any controversy, the Court of Treviso will have exclusive jurisdiction, with the exception of disputes with Consumer Customers which will be the responsibility of the Judicial Authority of the place of residence or domicile of the Consumer Customer.
The Consumer Customer has the right to promote the out-of-court resolution of disputes relating to the relationship of consumption at the institutes of the Chambers of Commerce, Industry and Crafts pursuant to law 29/12/1993 n. 580 as well as to resort to the mediation procedures referred to in Legislative Decree 28/2010 and subsequent amendments, under the conditions provided by the body chosen by the Customer who will administer this procedure.
